What is Ajnara Ambrosia Social Welfare Society (AASWS) ?
A. Ajnara Ambrosia Social Welfare Society (henceforth referred to as AASWS) is a registered society under Societies Registration Act 1860 and further amendments and rules made by UP Government. It is a group of people who are homebuyers of project Ajnara ambrosia located at Housing Plot No. GH-01, Sector-118, Noida, Gautam Buddha Nagar. -
Why was AASWS formed and by whom?
A. AASWS was formed by homebuyers of the projects ‘Ajnara ambrosia’ at a time when homebuyers has been struggling at various forums, groups, courts to seek justice for their delayed projects. The project has been stalled from a long time. The time lines for the completion of the units have been lapsed, which led to a litigation a group of homebuyers impleaded in the petition so as for court to hear their concerns and keep them in mind and give justice. At this point many homebuyers suggested to form a society to make it easier to collect documentation and funding for expenses required for representing them for their welfare, as society will give them a legal entity for better representation. Thus AASWS was formed and we are accepting new members who firmly believe in our aims and objectives. -
What is the purpose of the society.
A. The purpose of the society is to carry out activities for welfare of its members with the objective of getting the flats delivered as soon as possible and do everything possible for welfare for all, be it for flat buyers. These activities shall be in line with its legally authorised objectives with consent of its members. -
If the purpose of the society is to file and pursue legal cases against any
other concerned party for welfare of its members, why is it not mentioned in the
bylaws?
A. Societies Registration Act 1860, defines as to for what objectives Societies can be formed which has a list of items however “Forming a society just for filing legal cases ”is not one of them. Objectives had to be in line with Societies Registration Act 1860 in order to get the society registered with welfare of its members in mind. -
Why AASWS is against reverse insolvency/Why forcing in court for COC?
A. AASWS members was first who welcome the project in reverse insolvency as ex-management shared the funding plan and construction was resumed. But after looking Ajnara Ambrosia project progress, other buyers also filed IA for their projects in NCLAT then ex-management stopped the funding and constuction. After that onward they are just passing the time so we are against the reverse insolvency as from last 3 years ex-management is failed to share any workable solution/plan. -
If Noida is agreed to recongnize Ajnara as co-developer of 50% of part of land then what is the issue?
A. From the starting of project, as per ex-management they are trying to resolved Noida Authority (NA) issue but main concern is Supertech is not paying their part and noida authority is not dividing the land.Even in 2022 a proposal was shared with NA for the pending dues payment which is not materilized till date.This time IRP has shared a propsoal by mentioning all issue.Still we are waiting for the clarity on other points which are major road blockers and dropped many mails to all stake holders to discuss on those issues but no one is ready to discuss as they do not have the answer most probably. Even IRP has filed an application in NCLAT court to implead NA in the case so court could provide direction. It will help us to move from this dead end. -
If society motto is construction, then why are not agreeing on Gulshan proposal?
A. We have given our consent in the starting of Jan, 2025 with simple term and condition while in revert we got the response from Gulshan with 6 pre-requisite where NA is an exernal factor which is not resolved till date. Home buyers (HB) has already filed an IA for further direction -
If Gulshan is also failed in construction, then tomorrow we can move to COC, who is stopping?
A. In todays date we have surplus While Gulshan plan success is depends on following factors- Buyer Receivable: As per Ajnara books (2022), buyers needs to pay 186/- cr, where more then 150/- needs to come from buyers whoes dues are more then 15/-lakh which is not possible without bank finance
- Bank Finance: Bank finance requires NA, RERA approval
- Noida Authority Approval:From 2013, as per ex-management they are following to NA to resolve this issue and still it is not resolved hence it is necessary to get Court Direction to get it resolved
- Lack of cashflow:In various meeting even ex-management is failed to share us the sufficient end to end cashflow which is causing us to not approve the Gulshan plan until there is any clarity on above mentioned issue

Why we have filed an application for forensic audit in NCLAT?
A. L&T commenced its funding for the Ajnara Ambrosia project from 2017, period from which period construction activity was largely suspended. Despite the halt, L&T has claimed an in-principle funding of ₹390 crore towards the project. Additionally, approximately 500 Builder Buyer Agreements (BBAs) were executed during this inactive phase.
Given the discrepancy between the signed BBAs and the actual progress on-site, we intend to initiate a forensic audit to trace and recover any funds that may have been misappropriated. The objective is to redirect such siphoned amounts back into the project to ensure its timely and transparent completion. -
Under which Act of law is the society registered?
A. The society is registered under the Societies Registration Act of 1860 and rules thereafter amended and updated by Government of Uttar Pradesh from time to time. -
Will every property buyer automatically come under the ambit of AASWS
society and have to follow its rules and pay maintenance?
A. To become a member, you have to apply for its membership on its prescribed form and by submitting required documents and then approved by its governing body through a formal procedure. Once you are a confirmed member then only you are obliged to follow society ’s bye laws. No one shall become member of society just by virtue of being a home buyer in Ajnara Ambrosia Social. -
If I join the society, would the society have rights to sell/dispose of my
property?
A. No, Society has no legal right over the property of its members and cannot sell or lease their properties. This is not a Group Housing Society and shall not own or manage affairs of residential properties. -
What will be the role of the Society where Ajnara is under IBC?
A. Society would take care of the rights of every homebuyer and would represent collectively before the various courts for the delivery and compensation as per the Laws. For claims, Each Member (Homebuyer) shall file separate claim and would be given a particular percentage of vote based on his filling of Claim Form and he himself has to Vote Only. It is only after All Claim Forms are scrutinized by the IRP / RP that COC is formed. Like in Elections, you cannot vote for your family member, the same rules apply here as well. For voting purpose., Society role is limited to Advisory Position Only. Society can only advise its members on how to vote –Yes or No –For a particular resolution citing the rationale behind it. But CAN ’T Vote on behalf of its members. Each member has to vote himself only on every resolution. -
I would want part of byelaws or objectives of society to be changed, how
can I do so?
A. Only members of society can bring such proposal at meeting of general body and to be adopted by 2/3rd majority. -
If I become a member of society and later do not agree with something, even if
approved by majority of members, what are my options?
A. If unfortunately such situation comes, you can resign from membership of society by submitting your resignation withdrawing your membership describing the reason. You will cease to be a member and any acts or rules shall not be applicable on you. -
Why does society needs so many documents for admission to society?
A. Governing body needs to ensure that members qualify eligibility of society membership and does due diligence toward KYC Following are documents required and justification:-- Any proof of allotment of unit in projects. Allotment Letter, Statement of Account, Payment Receipts etc.
- Any one Photo ID Documents –To verify details and identity of members. Governing body is responsible for ensuring proper and necessary KYC of its members and also to safeguard the information collected from its members.
